Terms of Service.

These Terms of Service ("Terms") are a binding agreement between you and Ember Dating App, Inc., a Delaware corporation ("Ember," "we," "us"). By creating an account or using Ember, you accept these Terms and our Privacy Policy. Ember is a dating community for adults: you must be 18 or older to use it, and honest, respectful behavior is a condition of membership, not a suggestion.

1. Eligibility & Your Account.

You must be at least 18 years old and legally able to enter this agreement. You may create one account, for yourself, with accurate information, your real name, real age, and recent photos of you. Your gender must be accurate, because it decides who sees your profile. We compare it with the sex on your verified ID; if they do not match, we review your profile before it is shown. You can change your gender in the app twice; after that, our support team can update it for you. You are responsible for keeping your login secure and for all activity on your account.

2. Community Standards, Zero Tolerance.

Ember has no tolerance for objectionable content or abusive users. The following result in content removal, account suspension, or permanent ban, at our discretion and without refund: harassment, stalking, or threats; hate speech or discrimination; nudity or sexually explicit content; any sexual content involving or directed at minors (reported to authorities); violence or promotion of self-harm; scams, solicitation, spam, or commercial promotion; impersonation or misrepresentation; and any illegal activity.

Every profile and conversation includes tools to report and block. Reports are reviewed, and we may remove content or users at any time to keep the community safe.

Safety Policy. Our Safety Policy explains prohibited conduct, identity and age verification, reporting, suspensions, bans, appeals, and safety resources. It is part of these Terms. Colorado members: read our Colorado Safety Policy Information.

3. Your Content.

You own what you post. By posting, you grant Ember a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within the service so the app can work (for example, showing your profile to potential matches). This license ends when you delete the content or your account, except where retention is required by law. We may review, moderate, or remove content that violates these Terms.

Photos you upload are screened automatically, and photos showing nudity, graphic violence, or hate symbols are rejected.

4. Safety.

We do not conduct criminal background checks on members. Use your judgment: meet in public, tell someone your plans, arrange your own transportation, and never send money or share financial information with anyone you meet on Ember. You are solely responsible for your interactions with other members.

The map shows members at an approximate, city-level position. You appear on it only after you agree and allow location; to leave it, turn off location access for Ember in your device settings, or pause your account.

5. Subscriptions & Purchases.

Ember Premium and other purchases on iOS are billed through your Apple ID. Subscriptions renew automatically until canceled at least 24 hours before the end of the current period; manage or cancel anytime in your device’s App Store subscription settings. Deleting the app does not cancel a subscription. Prices may change with notice, and refunds are handled by Apple under their terms.

Invitation rewards and ambassadors. When someone joins Ember through your invitation link and completes ID verification, you and they each receive Premium days (more in countries where one side of the community is underrepresented, as shown in the app). After 3 verified invitations you become an Ember Ambassador and receive a month of Premium and a profile badge; after 10 you become a Lead Ambassador and receive 90 days of Premium. Rewards are given once per newly verified member, have no cash value, and cannot be transferred. Inviting yourself, creating fake or duplicate accounts, or any other abuse of the program cancels the rewards and may lead to a permanent ban. We may change or end the program at any time; rewards already granted stay in effect.

6. Prohibited Uses.

You may not scrape, harvest, or collect data from Ember; use bots or automation; reverse engineer the service; bypass security or rate limits; or use Ember for any commercial purpose without our written consent.

7. Termination.

You can delete your account at any time in Settings, which removes your profile from the service. We may suspend or terminate accounts that violate these Terms. Sections that by their nature should survive termination (including licenses granted, disclaimers, and limitations of liability) survive.

8. Disclaimers & Limitation of Liability.

Ember is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, Ember is not liable for the conduct of any member, on or off the service, or for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

9. Changes & Governing Law.

We may update these Terms; material changes will be announced in the app, and continued use means acceptance. These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules.
