These Terms of Service ("Terms") are a binding agreement between you and Ember ("we," "us"). By creating an account or using Ember, you accept these Terms and our Privacy Policy. Ember is a dating community for adults: you must be 18 or older to use it, and honest, respectful behavior is a condition of membership, not a suggestion.
1. Eligibility & Your Account
You must be at least 18 years old and legally able to enter this agreement. You may create one account, for yourself, with accurate information, your real name, real age, and recent photos of you. You are responsible for keeping your login secure and for all activity on your account.
2. Community Standards, Zero Tolerance
Ember has no tolerance for objectionable content or abusive users. The following result in content removal, account suspension, or permanent ban, at our discretion and without refund: harassment, stalking, or threats; hate speech or discrimination; nudity or sexually explicit content; any sexual content involving or directed at minors (reported to authorities); violence or promotion of self-harm; scams, solicitation, spam, or commercial promotion; impersonation or misrepresentation; and any illegal activity.
Every profile and conversation includes tools to report and block. Reports are reviewed, and we may remove content or users at any time to keep the community safe.
3. Your Content
You own what you post. By posting, you grant Ember a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within the service so the app can work (for example, showing your profile to potential matches). This license ends when you delete the content or your account, except where retention is required by law. We may review, moderate, or remove content that violates these Terms.
4. Safety
We do not conduct criminal background checks on members. Use your judgment: meet in public, tell someone your plans, arrange your own transportation, and never send money or share financial information with anyone you meet on Ember. You are solely responsible for your interactions with other members.
5. Subscriptions & Purchases
Ember Premium and other purchases on iOS are billed through your Apple ID. Subscriptions renew automatically until canceled at least 24 hours before the end of the current period; manage or cancel anytime in your device’s App Store subscription settings. Deleting the app does not cancel a subscription. Prices may change with notice, and refunds are handled by Apple under their terms.
6. Prohibited Uses
You may not scrape, harvest, or collect data from Ember; use bots or automation; reverse engineer the service; bypass security or rate limits; or use Ember for any commercial purpose without our written consent.
7. Termination
You can delete your account at any time in Settings, which removes your profile from the service. We may suspend or terminate accounts that violate these Terms. Sections that by their nature should survive termination (including licenses granted, disclaimers, and limitations of liability) survive.
8. Disclaimers & Limitation of Liability
Ember is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, Ember is not liable for the conduct of any member, on or off the service, or for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
9. Changes & Governing Law
We may update these Terms; material changes will be announced in the app, and continued use means acceptance. These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules.
